I, HENRY HERRING, of the County of Lenoir and State of North Carolina being of Sound mind and Memory, but considering the uncertainty of every Earthly existence do make and ordain This my Last Will and Testaments, the manner and form following that is to Say. First that Every Execution herein after named that Provide for Everybody a decent burial Suitable to the Wishes of Every Relations, Friends, and Pay All funeral expenses together with Every Just debts. Howsoever and To whomsoever owing out of the moneys that may first Come into his hands as a part or partial of my Estate. Item: I leave to my beloved wife, BARBARA HERRING during Her Natural Life the following property to wit: Six Negroes, Known by the Names of JACOB, WASHINGTON, MILEY, JAMES, JACKSON, CAROLINA and after her death I will and desire that the whole xxx a foresaid Negroes together with their increase be Equality divided between my Seven(7) children (viz)SMITHY POWELL, WILLIAM, JOSIAH, JOSHUA, JAMES, BARBARA, & GEORGE HERRING, also Two Head Horses or Mules, his choice, Four Sows and Twenty Shoats, Four Cows and Calves, Six Head Sheep to her, her heirs and assigns forever. Item: I leave to my beloved Daughter SMITHY POWELL the following Property during her Natural Life and in the Event of her leaving Lawful Issue, I will and desire that the Property Hereinafter described shall descend to them Equally. Share and Share alike(viz) Seven Negroes Known by the Names of FANNY, TOM, MARGARETT, CHARITY, NINA, CLARRINA, ADDISON and in the event of the Said SMITHY dying without Lawful Issue the xxx in that case it is my will and desire that the whole of the above Named Negroes and their increase be Equally Divided between all my children as heretofore named in the First Item. Said SMITHY only Excepted. Item: I give and bequeath to my beloved Son WILLIAM HERRING the following named Negroes to wit: CALVIN, LUCINDA, KELSY, LIZZY, HARRIET, GATSY to Him his Heirs and Assigns forever. Item: I give and bequeath unto my beloved Son JOSIAH G.HERRING the following Named Negroes to wit: xxx, xxx to Him, his Heirs or Assigns forever. Item: I give and bequeath to my beloved Son JOSHUA HERRING the following Named Negroes to wit: MARTIN and EMMALINE to Him, his Heirs, or Assigns forever. Item: I give and bequeath to my beloved Son JAMES HERRING the following Negroes to wit: RANDALL ADISON, a Son of CHARLOTTS & PEANSY to Him, his Heirs, or Assigns forever. Item: I give and bequeath to my beloved Daughter BARBARA the following Named Negroes to wit: JESSE, GEORGE, LOTIN, ELVY, QUINEY, LISA, SUSANNA, BARNY, TILDA, ESTHER, MARY, and DICA to Him, his Heirs or Assigns forever. Item: I give and bequeath to my beloved Son GEORGE HERRING the following Named Negroes to wit: JESSE, BRYD, RIDDICK, CHARLOTT, and JULIA to Him, his Heirs, Assigns forever. Also I give and bequeath to the Said GEORGE, 300 Acres of Land including the Houses and Premises which I now Reside. Beginning at the Dividing Line between myself and JOHN S. CROOM and running a North East Course to Fawling Creek and then with the Creek so far as to Include the Premises as aforesaid. Item: I will and desire that All the Rest and Residence of my Estate not Herein before Specified, be Sold and the Proceeds of such Sale be Equally Divided between All my Children to wit: SMITHY POWELL, WILLIAM, JOSIAH G. HERRING, JAMES, BARBARA, and GEORGE HERRING. Share and Share alike Exactly. I Nominate, Constitute, and Appoint my Son JOSIAH G. HERRING as Sole Executor to this my Last Will and Testament, to all interest and purposes according to the True intent and meaning of the Same and Every Part and clause thereof. Hereby revoking and disclaiming. Void All other Wills and Testaments by me Heretofore made. In Witness whereof: I, the Said HENRY HERRING do Hereunto Set my Hand and Seal this 15th April in the year of our Lord 1845. Signed, Sealed, Published and Advertised by the said HENRY HERRING to be His Last Will and Testament in the Presence of us: Who at His Request in His Presence do Subscribe our names as Witness Hereto: HENRY HERRING P. HARDEE JOSIAH ALDRAGE State of NC: Lenoir County: I, W.C. LOFTIN, Clerk of Said County Court do Certify foregoing to be a true copy of the Last Will and Testament of HENRY HERRING and in Testimony whereof, I hereunto Subscribe W.C.LOFTIN, CLERK
